Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Snapfine Tech LLC, a Delaware limited liability company ("Snapfine Tech," "Company," "we," "us," or "our"), governing your access to and use of the JustEatSmart application, website, and all related services (collectively, the "Service"). By accessing or using the Service, you affirm that you have read, understood, and agree to be bound by these Terms in their entirety. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICE.

1Acceptance of Terms

By creating an account, signing in, or otherwise accessing the Service, you acknowledge that (a) you are at least 18 years of age or have the legal capacity to enter into binding contracts in your jurisdiction; (b) you have read and agree to these Terms and our Privacy Policy; and (c) you have the authority to bind any entity on whose behalf you access the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after any modification constitutes acceptance of the revised Terms.

2Third-Party Content, YouTube API Services & Intellectual Property

The Service aggregates and displays content from third-party platforms, including but not limited to YouTube ("Third-Party Content"). Snapfine Tech LLC does not own, create, produce, or claim any rights in or to any video content, recipes, descriptions, images, or other materials originating from third-party creators or platforms.

YouTube API Services. The Service integrates with YouTube API Services provided by Google LLC. By using any features that interact with YouTube content, you additionally agree to be bound by: (i) the YouTube Terms of Service; (ii) Google's Privacy Policy; and (iii) all applicable YouTube API Services Policies. You acknowledge that Google may collect data in connection with your use of YouTube API Services and that Snapfine Tech LLC has no control over such data collection. Videos are displayed exclusively via the YouTube IFrame Player API — no video content is downloaded, hosted, stored, or reproduced by Snapfine Tech LLC at any time.

Public Data Indexing & Creator Content. The Service operates as a search index and discovery platform for publicly available content. All video titles, descriptions, thumbnails, channel names, subscriber counts, view counts, and other metadata retrieved by the Service are sourced exclusively from the YouTube Data API v3 — an official, publicly accessible API provided by Google LLC and subject to the YouTube API Services Terms of Service. This data is made publicly available by content creators themselves by virtue of publishing content on YouTube, a public platform.

Snapfine Tech LLC does not reproduce, copy, host, download, or redistribute any video content. The Service does not create, modify, or claim authorship over any video, recipe, description, image, or creative work originating from any third-party creator. Content is accessed and displayed in the same manner as any standard internet search engine, news aggregator, or directory service that indexes publicly available data pursuant to applicable fair use and database doctrines.

All intellectual property rights in video content, channel branding, and creative works remain exclusively with their respective owners. The display of such publicly available metadata within the Service does not constitute infringement, misappropriation, or breach of any creator's intellectual property rights. If you are a content creator and believe your content has been displayed in error or in a manner inconsistent with your wishes, please contact us at legal@snapfine.tech and we will promptly review and, where appropriate, remove such content.

Our Intellectual Property. All software, user interface designs, trademarks, logos, and proprietary compilations constituting the Service are owned by Snapfine Tech LLC and protected under applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for personal, non-commercial purposes.

NO MEDICAL, DIETARY, OR NUTRITIONAL ADVICE. The Service, including all recipes, meal plans, ingredient lists, nutritional estimates, calorie counts, and grocery suggestions, is provided for general informational and entertainment purposes ONLY. Snapfine Tech LLC is NOT a licensed medical provider, registered dietitian, certified nutritionist, allergist, or health care professional. NOTHING in the Service constitutes medical advice, dietary advice, or a recommendation for any specific health condition or dietary requirement.

ALLERGY WARNING. Snapfine Tech LLC makes NO representations whatsoever regarding the presence or absence of allergens — including but not limited to nuts, gluten, dairy, eggs, soy, shellfish, fish, wheat, or any other known or unknown allergen — in any recipe or ingredient displayed through the Service. Individuals with food allergies, intolerances, or medical dietary restrictions MUST independently verify all ingredient information with a qualified healthcare professional BEFORE cooking or consuming any recipe found on the Service. YOU ASSUME ALL RISK associated with food allergies and dietary restrictions.

COOKING SAFETY. Cooking involves inherent risks including but not limited to burns, cuts, fires, and foodborne illness. You are solely responsible for your own safety and the safety of others while using any recipe or meal plan from the Service. Snapfine Tech LLC assumes no liability for any injuries, accidents, or property damage occurring in connection with your use of the Service.

COMPLETE INDEMNIFICATION. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SNAPFINE TECH LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL HAVE ABSOLUTELY NO LIABILITY WHATSOEVER FOR ANY ADVERSE HEALTH OUTCOME, FOOD POISONING, ALLERGIC REACTION, ANAPHYLAXIS, HOSPITALIZATION, INJURY, DEATH, PROPERTY DAMAGE, OR ANY OTHER HARM ARISING FROM OR RELATED TO: (a) YOUR USE OF ANY RECIPE, MEAL PLAN, OR INGREDIENT INFORMATION PROVIDED BY THE SERVICE; (b) YOUR RELIANCE ON ANY NUTRITIONAL OR CALORIC INFORMATION DISPLAYED; OR (c) ANY COOKING ACTIVITY UNDERTAKEN BASED ON CONTENT FROM THE SERVICE.

🤖Artificial Intelligence & LLM Recipe Extraction — Accuracy Disclaimer

AI-GENERATED CONTENT. Recipes, ingredient lists, measurements, cooking instructions, and nutritional estimates displayed in the Service may be partially or entirely extracted, generated, summarized, or structured using artificial intelligence systems, including large language models ("LLMs"). You acknowledge and agree that AI-extracted content:

  • May contain material errors, omissions, or inaccuracies in ingredient names, measurements, quantities, temperatures, cooking times, or procedural steps;
  • May not accurately reflect the original creator's intended recipe;
  • May omit critical safety information including allergen warnings, safe minimum cooking temperatures, or proper food handling instructions;
  • May produce hallucinated or fabricated information that has no basis in the source content;
  • Is not reviewed by a licensed culinary professional, food scientist, or nutritionist prior to display.

USER RESPONSIBILITY. YOU ARE SOLELY RESPONSIBLE FOR INDEPENDENTLY VERIFYING THE ACCURACY, SAFETY, AND COMPLETENESS OF ANY AI-EXTRACTED RECIPE BEFORE PREPARING OR CONSUMING IT. Snapfine Tech LLC expressly disclaims all liability for errors, inaccuracies, or omissions in AI-generated or AI-extracted recipe content. Your reliance on such content is entirely at your own risk.

5User Accounts & Authentication

The Service supports account creation through third-party OAuth providers including Google LLC and Apple Inc. By authenticating through these providers, you agree to their respective terms of service and privacy policies in addition to these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You agree to notify us immediately at legal@snapfine.tech of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

6Pantry, Meal Planning & User-Generated Data

The Service enables you to store personal data including pantry inventory, expiration dates, grocery lists, and weekly meal plans ("User Data"). You retain all ownership rights to your User Data. You grant Snapfine Tech LLC a limited, non-exclusive, worldwide, royalty-free license to store, process, and display your User Data solely for the purpose of providing the Service.

We make no guarantee of data availability, backup, or recovery. Pantry and meal plan data may be lost in the event of system failures, maintenance, or account termination. You are solely responsible for maintaining independent copies of any User Data you wish to preserve.

7Advertising & Monetization

The Service displays advertisements served by third-party advertising networks including Google AdSense. These networks may use cookies, pixel tags, and similar tracking technologies to serve targeted advertisements based on your browsing activity. Snapfine Tech LLC is not responsible for the content, accuracy, or privacy practices of third-party advertisements. Clicking on advertisements may direct you to third-party websites, which are governed by their own terms and policies.

8Prohibited Conduct

You agree not to, and will not permit any third party to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Scrape, crawl, or otherwise extract data from the Service using automated means without our express written consent;
  • Attempt to gain unauthorized access to any portion of the Service or its related systems;
  • Reverse engineer, decompile, or disassemble any portion of the Service;
  • Circumvent, disable, or interfere with any security-related features of the Service;
  • Use the Service to transmit any viruses, malware, or other harmful code;
  • Impersonate any person or entity or falsely represent your affiliation with any person or entity;
  • Use the Service for commercial purposes without our prior written consent.

9Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SNAPFINE TECH LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, INCLUDING AI-EXTRACTED RECIPES;
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SNAPFINE TECH LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL;
  • PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH;
  • DAMAGES ARISING FROM YOUR RELIANCE ON AI-GENERATED RECIPE CONTENT;
  • DAMAGES ARISING FROM FOOD ALLERGIES, FOODBORNE ILLNESS, OR COOKING ACCIDENTS.

IN JURISDICTIONS THAT DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (a) USD $50.00 OR (b) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11Indemnification

You agree to defend, indemnify, and hold harmless Snapfine Tech LLC and its members, managers, officers, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and attorneys' fees arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service; (c) your User Data; (d) any food preparation, cooking, or consumption activity based on content from the Service; (e) your infringement of any third-party rights; or (f) any negligent or wrongful conduct by you.

12Governing Law, Jurisdiction & Dispute Resolution

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles.

Exclusive Jurisdiction. Any legal action, suit, or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the state or federal courts located in New Castle County, Delaware, USA. You irrevocably and unconditionally submit to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.

Waiver of Jury Trial. TO THE FULLEST EXTENT PERMITTED BY LAW, BOTH PARTIES HEREBY IRREVOCABLY WAIVE ANY AND ALL RIGHTS TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

13Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. Sections 3, 4, 8, 9, 10, 11, and 12 of these Terms shall survive any termination.

14General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Snapfine Tech LLC regarding the Service.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms freely.
